Injury Claims
Motor Accidents, Workers Compensation, Public
Liability, Criminal Injuries
If you have been injured in an accident, whether
in a motor car, at work, on someone’s property, on public
land, or as a result of an assault, you may well have a claim
for compensation.
Free First Interview
Scammell & Co will give you a free first half hour interview
to assess whether you are entitled to bring such a claim.
In nearly all cases, if you have a good claim
and follow our advice, we will obtain payment of the legal costs
out of the settlement proceeds of your claim and you will therefore
not have to pay for our services until the end of the claim when
you have money available from the claim.
Procedure if you have
a claim
If you have a claim then we will handle all negotiations with
the relevant insurer direct. We will obtain medical reports from
hospitals and your treating doctor relating to your injuries,
notify the other person(s) in the accident and sometimes attend
the scene of the accident.
Throughout your claim we will liaise with you,
the insurer and the doctors to obtain enough information to accurately
assess your compensation. Our job, as your solicitor, is to handle
everything for you.
How long will it take?
Claims cannot be finalised until you have either fully recovered
or recovered as well as you are going to in the opinion of your
doctor.
That is because an assessment of your future
medial expenses and permanent incapacity (if any) forms a part
of your claim. If you have suffered a serious injury and need
a long rehabilitation process the time to settle your claim may
take longer to resolve.
However, once your claim is settled, it is finished
once and for all. It is therefore important that the claim is
not resolved until we are fully informed as to what future problems
you may have. How long your claim takes is dependent on your recovery.
What are you entitled
to claim for?
Before your claim is settled we will take into account your pain
and suffering, the wages that you may have lost (from not being
able to go to work), your medical expenses both past and future
interest, compensation for loss of future earning capacity (if
your ability to work is reduced) and costs. We will discuss these
entitlements with you throughout your claim.
